    Regional Planning Guidelines

    These are issued by the South Eastern Regional Authority , and relate to the development of the South Eastern Region, which covers the Counties of South Tipperary, Kilkenny, Carlow, Wexford, and Waterford, and the City of Waterford.

    Planning Guidelines

    The Minister for the Environment, Heritage, and Local Government has issued a number of guidelines relating to various aspects of the planning process.

    Development Plan

    The current development plan was adopted in early 2008, and there has been one variation in it since then. A progress report on the implementation of the plan was given to the elected members of the Borough Council in early 2010. Work on the review of the plan will begin in 2012.

    County Retail Strategy

    The County Retail Strategy is prepared by South Tipperary County Council, and sets out a vision for the development of retail facilities in the county as a whole.

    Planning Permission

    In general it is necessary to obtain permission from the Borough Council before building work is carried out, or before the use to which land or a building is put is changed.

    The Council’s planners are available to discuss plans at a pre planning meeting in advance of the making of an application. If you wish to use this service, please contact the planning section at 052 618 3800.

    If you are unsure whether particular work or change of use requires planning permission, you can apply to have a declaration made by the Borough Council on the matter. The declaration made by the Borough Council can be appealed to An Bord Planeala.

    To apply for planning permission, an application form is completed and submitted to the council with the plans and specifications of the proposed work. If you are applying for permission, you should also be aware of the scale of fees, and the requirements for publishing notice.

    Application Forms

    Any person can view a planning application during normal office hours. Any person can object or make an observation on a planning application on payment of a fee. All objections or observations are considered when an application is being determined. The most recent applications are available at Planning Lists.

    You may be required to submit additional information to expand on or clarify aspects of your planning application. When this is received by the Borough Council, you may be required to give notice that further information has been submitted.

    A decision will be made on the application within eight weeks of the application, or six weeks of the submission of further information. The decision will be to refuse the application, or to grant with or without conditions. The person who applied for permission, and any person who made on objection or observation, may appeal the decision to An Bord Planeala. Once the time for appeal is passed, the permission will be granted.

    Planning Contributions

    The work carried out by the Borough Council and other public bodies in providing infrastructure enables private developers to carry out their developments. It is reasonable therefore to have the private developers contribute towards the cost of that infrastructure. The contributions are calculated in accordance with the Planning Contribution Scheme 2009-2014.

    Planning Enforcement

    Where a person carries out a development without permission, or breaches a condition of the permission, the Borough Council’s planning inspector carries out an inspection and enforcement action is taken. The purpose of enforcement action is to make sure the planning code is adhered to rather than to punish the developer. Enforcement action takes the form of a warning letter, followed by an enforcement notice, followed by court action.

    If you are aware of a breach of the planning code, you should write to the Borough Council with details of the breach, the developer, and your own name and address. If you recieve a warning letter or an enforcement notice from Clonmel Borough Council, you should contact the Planning Section as soon as possible to see how the issue can be resolved.
